Personal Information Protection Act (British Columbia)
Tanvi Ahuja Notary Corporation, doing business as Hummingbird Notaries (“the Corporation”, “we”, “us”, or “our”), is committed to protecting personal information in accordance with the Personal Information Protection Act (British Columbia) (“PIPA”), the Notaries Act, and the professional standards governing Notaries Public in British Columbia.
As a notary corporation, we routinely handle confidential and sensitive personal information. We recognize the trust placed in us by our clients and others and take our legal and professional obligations seriously.
Personal Information
“Personal information” means information about an identifiable individual, whether recorded in writing, electronically, or in any other form.
Purposes for Collection of Personal Information
We collect personal information for purposes that are reasonable and necessary to provide notarial and legal services, including:
- verifying identity and capacity
- providing legal advice and notarial services
- preparing, executing, witnessing, certifying, and registering documents
- complying with statutory, regulatory, and professional obligations under the Notaries Act
- maintaining records as required by law and by the Society of Notaries Public of British Columbia
Personal information may relate to our clients and, where applicable, to other individuals involved in a transaction or matter.
Collection, Use, and Disclosure
Where reasonable and practicable, we collect personal information directly from the individual to whom it relates. In some circumstances, we may collect personal information from third parties, such as government registries, financial institutions, or other professionals, where authorized or required.
By engaging Tanvi Ahuja Notary Corporation (operating as Hummingbird Notaries), clients consent to the collection, use, and disclosure of their personal information for purposes that a reasonable person would consider appropriate for the provision of notarial and legal services.
We may also collect personal information about individuals who are not our clients where permitted under PIPA. Consent may be implied where the purpose for the collection, use, or disclosure would be obvious to a reasonable person.
PIPA permits the collection, use, or disclosure of personal information without consent in limited circumstances authorized by law. In all cases, we limit collection to information reasonably necessary for the intended purpose and take reasonable steps to ensure accuracy.
Confidentiality and Notary-Client Privilege
All personal information obtained in the course of providing notarial services is subject to strict duties of confidentiality. Information protected by notary-client privilege will not be disclosed except where authorized by the client or required by law.
Safeguards
We use reasonable administrative, physical, and technological safeguards to protect personal information against unauthorized access, use, disclosure, copying, modification, or disposal. Safeguards are appropriate to the sensitivity of the information and the nature of our practice.
Retention of Personal Information
Personal information is retained only for as long as reasonably necessary to fulfill the purposes for which it was collected and to meet legal, professional, and regulatory record-keeping requirements.
Access to Personal Information
Individuals may request access to:
- personal information we hold about them
- information about how their personal information has been used or disclosed
- the names of persons or organizations to whom their personal information has been disclosed
Requests will be handled within the timeframes required by PIPA. Fees may apply where permitted by law.
Limits on Access
Access may be refused where permitted by PIPA, including where disclosure:
- could reasonably be expected to threaten the safety or health of another individual
- would cause immediate or serious harm to the requester’s mental or physical health
- would reveal personal information about another individual
- would identify a confidential source
Information protected by notary-client privilege or otherwise exempt under PIPA will not be disclosed.
